1. Definitions

1.6 Prohibited Waste means any hazardous, specialist or restricted materials which we are not authorised to collect or dispose of under applicable law or our licences, including but not limited to asbestos, clinical waste, chemicals, solvents, gas cylinders, fuel, explosives, biological waste and certain electrical goods where separate arrangements are required.

2. Scope of Services

2.1 We provide rubbish removal and waste collection services for domestic and commercial customers. This may include collection of bagged waste, loose waste, bulky items, garden waste, office waste, construction and refurbishment waste, and general clearance of premises.

2.2 Our Services are limited to non-hazardous waste unless otherwise expressly agreed in writing in advance and subject to any additional charges and regulatory requirements that may apply.

2.3 We reserve the right to refuse to collect any Waste which we reasonably believe to be Prohibited Waste, unsafe to handle, incorrectly described, inadequately packaged or otherwise unsuitable for collection or transportation.

2.4 All Services are provided subject to availability of staff, vehicles and any necessary licences or permits.

3. Booking Process

3.1 You may request a rubbish removal booking by telephone, email or through our online enquiry channels. We may ask for details including the type and approximate volume or weight of Waste, the collection address, access arrangements and any time restrictions.

3.2 Any quotation provided before on-site assessment is an estimate only, based on the information you provide. Final pricing may be adjusted after our team inspects the Waste on arrival.

3.3 A booking is considered confirmed once we have agreed a date, time window, and estimated price with you, and you have accepted those terms. For certain jobs, we may require an advance payment or deposit to secure the booking.

3.4 You are responsible for ensuring that the information you provide during the booking process is accurate and complete. Additional charges may apply if the Waste or access conditions differ significantly from the description given by you.

3.5 We will use reasonable endeavours to attend at the agreed time, but time is not of the essence for performance of our Services. Factors such as traffic, weather and previous bookings may affect arrival times. We will contact you if we anticipate a significant delay and arrange an alternative time where necessary.

4. Access and Service Requirements

4.1 You must ensure that our team has safe, timely and reasonable access to the collection address, including any necessary keys, codes, parking permissions or entry passes.

4.2 You are responsible for obtaining any permissions required from building management, neighbours, local authorities or other third parties to enable us to perform the Services.

4.3 If we are unable to carry out the Services due to lack of access, unsafe conditions, incorrect address details or other circumstances within your control, we may charge a call-out fee and any wasted time and costs incurred.

4.4 You must ensure that any fragile items, valuables or personal belongings not intended for removal are clearly separated from the Waste and suitably protected. We will not be responsible for items removed in error where they were not reasonably identifiable as non-waste.

5. Pricing and Payments

5.1 Our charges are based on one or more of the following: volume of Waste, weight, type of materials, loading time, labour required, access conditions and distance travelled. We may provide pricing bands or minimum charges to reflect typical rubbish removal loads.

5.2 All prices quoted are exclusive of any applicable taxes unless otherwise stated. Where relevant, VAT or other taxes will be added at the prevailing rate.

5.3 We may provide a price estimate prior to arrival based on your description of the Waste. The final price will be confirmed on site once our team has assessed the actual volume, weight and nature of the Waste and any access issues.

5.4 Unless otherwise agreed in writing, payment is due in full on completion of the Services on the day of collection. We accept commonly used payment methods such as cash, debit or credit card, and bank transfer where available.

5.5 For business customers or larger projects, we may agree alternative payment terms, including deposits, staged payments or payment on invoice. Such terms will be set out in writing and must be complied with strictly.

5.6 If you fail to pay any sum due on the due date, we reserve the right to charge interest on the unpaid amount from the due date until payment is received in full, at the statutory rate applicable to commercial debts or, where not applicable, at a reasonable rate reflective of our costs of recovery.

6. Cancellations and Rescheduling

6.1 You may cancel or reschedule a booking by contacting us as soon as reasonably possible.

6.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will normally apply, unless we have incurred specific costs or ordered special equipment for your job, in which case a reasonable charge may be made.

6.3 If you cancel within 24 hours of the scheduled collection time, or if we are unable to carry out the Services due to your failure to provide access or other reasons within your control, we may charge a cancellation fee or call-out fee to cover our time and any costs incurred.

6.4 If you wish to reschedule, we will use reasonable efforts to arrange a new collection slot. Rescheduling within 24 hours of the original appointment may be treated as a cancellation and rebooking and may incur additional charges.

6.5 We reserve the right to cancel or postpone the Services at any time for reasons including but not limited to unsafe conditions, severe weather, vehicle breakdown, staff illness or other events beyond our reasonable control. In such cases, we will offer an alternative date or, if this is not acceptable, a refund of any amounts paid in advance for the affected Services.

7. Waste Regulations and Duty of Care

7.1 We operate in accordance with relevant UK waste management legislation and regulations. We will transport and dispose of Waste using appropriately licensed facilities wherever required.

7.2 By using our Services, you confirm that you have the right to give us the Waste for removal and that the Waste is not stolen or unlawfully obtained.

7.3 You must not provide Prohibited Waste unless we have expressly agreed in writing to handle such material and we are properly authorised to do so. If we discover Prohibited Waste among the load, we may refuse to remove it or may levy a surcharge and arrange for specialist disposal where appropriate.

7.4 We will take reasonable steps to segregate and recycle Waste where practicable, in line with our environmental responsibilities and available facilities. However, we do not guarantee that any particular item or proportion of the Waste will be recycled.

7.5 You have a legal duty of care to ensure that your Waste is transferred only to an authorised carrier and is correctly described. Our involvement in the removal of your rubbish helps you meet that obligation, but you must still provide accurate information about the type and source of the Waste.

8. Customer Responsibilities

8.1 You must ensure that the Waste is reasonably accessible and, where possible, consolidated in one area ready for collection. Additional charges may apply where our team is required to collect Waste from multiple rooms, levels, or distant locations, or where significant dismantling is required.

8.2 Where heavy or awkward items are to be removed, you must inform us at the time of booking so that we can allocate appropriate staff and equipment. We may refuse to remove items that pose a health and safety risk if we have not been notified in advance.

8.3 You are responsible for ensuring that all personal data and sensitive information are removed from any items given to us, such as documents, electronic devices or storage media. We do not undertake data destruction services and will not be liable for any loss or misuse of data once items have been collected as Waste.

9. Liability and Limitations

9.1 We will exercise reasonable care and skill in providing the Services. If we cause damage to your property through our negligence, we will, at our option, either repair the damage or pay fair compensation, subject to the limitations set out in this clause.

9.2 We will not be liable for any damage or loss caused by defects or weaknesses in your property, including but not limited to worn or loose flooring, stair coverings, pathways, driveways, walls, gates or structural elements that could not reasonably have been identified as unsafe prior to or during the provision of the Services.

9.3 We will not be liable for any indirect or consequential loss, including loss of profit, loss of business, loss of opportunity, or loss of data, arising out of or in connection with the Services.

9.4 Our total liability to you in respect of any claim arising under or in connection with the Services, whether in contract, tort including negligence or otherwise, shall not exceed the total amount paid or payable by you for the specific Service giving rise to the claim, except where such limitation is not permitted by law.

9.5 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

10. Insurance

10.1 We maintain insurance cover appropriate to the nature of our rubbish removal and waste collection activities. Details of our insurance arrangements can be made available upon reasonable request.

10.2 Our insurance applies subject to the terms, conditions and exclusions of the relevant policy or policies, and our liability to you will not exceed the amount recoverable under such insurance where applicable.

11. Complaints and Dispute Resolution

11.1 If you are dissatisfied with any aspect of our Services, you should notify us as soon as possible, providing your name, address, contact details, the date of the Service and a description of your concerns.

11.2 We will investigate complaints in a fair and timely manner and will make reasonable efforts to resolve the issue, which may include revisiting the site, providing an explanation, correcting any errors or offering a partial refund where appropriate.

11.3 If we are unable to resolve a dispute informally, either party may seek redress through the courts or other lawful dispute resolution processes.

12. Force Majeure

12.1 We shall not be in breach of these Terms and Conditions nor liable for delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control, including but not limited to extreme weather, fire, flood, pandemic, strike, industrial action, road closures, vehicle breakdown, or failure of utilities or communications networks.

12.2 In such circumstances, we may suspend the Services for the duration of the event, or cancel the affected Services and provide a refund of any sums paid in advance for work not carried out.

13. Privacy and Data Protection

13.1 We will collect and process personal information about you in order to manage bookings, provide the Services, process payments and handle enquiries. Such information may include your name, contact details, service address and payment details.

13.2 We will handle your personal information in accordance with applicable data protection laws and will take reasonable measures to protect it against unauthorised access, loss or misuse.

13.3 We may retain records of your bookings and transactions for a reasonable period for administrative, legal and accounting purposes.

14. Amendments to these Terms

14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our services, legal requirements or business practices.

14.2 The version of the Terms and Conditions in force at the time you make your booking will apply to that booking, unless we agree otherwise in writing or changes are required by law.

15. Severability

15.1 If any provision of these Terms and Conditions is held by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable. If such modification is not possible, the relevant provision shall be deleted, and the remaining provisions shall continue in full force and effect.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided.

17. Entire Agreement

17.1 These Terms and Conditions, together with any written quotation or confirmation issued by us, constitute the entire agreement between you and us concerning the provision of our rubbish removal and waste collection services and supersede any prior discussions, correspondence or understandings between us relating to the same subject matter.

17.2 You acknowledge that you have not relied on any statement, representation, assurance or warranty not expressly set out in these Terms and Conditions.
